The payments made, via Cheque/Wire Transfer/PayPal, would be done to IBSMAXX, Kolkata. Once we receive your acceptance of our proposal, related information, and the applied fees, we would be more than happy to start with the project. IBSMAXX would not be liable for any damages, including loss of profits, loss of savings, or any other consequential/accidental damage. Plus, the client must provide IBSMAXX the guarantee that all the information (text, images, audios, graphics, source codes & any other artwork) is owned by the client itself. Or the client has permission from the rightful owner to use the stated information. Also, the client would hold harmless & defend IBSMAXX from any claims or suits that arise from the use of the information provided by the client.
Website Project Development: While briefing us about the project, it is the sole responsibility of the client to provide all the clear guidelines as well as any specific details that they want. In the event such details are not provided, we would be proceeding as per our understanding of the requirements mentioned by the client. If any discrepancy arises, it can lead to additional charges. Once the proposal has been finalized, any sort of addition or enhancement to the design or functionality can lead to additional charges as well as a revised plan date. Also, any additional work would be charged separately. And IBSMAXX would not be liable for the delays caused.
Dedicated Resource: The client is allocated all the dedicated resources, including support staff. If requested, a project manager or team leader can also be allocated. The designer or developer allocated is on a dedicated basis, therefore, he or she must have tasks assigned all the time to avoid delays. All IBSMAXX employees have confidentiality clauses with their employment and have non-disclosure agreements signed.
Hosting Service: It is an annual charge that must be paid in advance. The client is solely responsible for the renewal of the hosting service before it expires. Failure in doing so might lead to loss of information, files, backups, etc. Any renewal must be done a week before the expiry date. In the event of any malware attack, IBSMAXX reserves the full right to delete the files on the hosting server without any prior notice.
Cancellation/Termination: For canceling the hosting service, the request must be sent via an email at least a month before the expiry date. The hosting service cannot be canceled once renewed. And if the hosting service is not renewed before the expiry date, IBSMAXX reserves the full right to disable all the services associated with hosting. In that event, we would not be liable for any loss of data, files, backups, etc.
Emails: All the emails are to be downloaded on to the client’s end periodically and the email inboxes must be kept & maintained within their assigned limit. Emails that are older than 6 months should be deleted. The client should never indulge in using email hosting for inappropriate content that might lead to spamming.
Domains: The renewal & registration of all domains must be done in advance. If a domain expires, it can lead to disruption of service and data. IBSMAXX would not be liable in the event of the domain expiring and the related losses.
Maintenance Plan: All the maintenance packages are for 3 months (minimum). The billing for the same is done quarterly and thus the fees for it should be paid on the 1st day of the quarter. Requests for any support should be sent to info@ibsmaxx.com.
Termination: If the client wants to cancel the auto annual renewal, please write to us a month before the renewal date. In case the client wants to terminate the on-going maintenance then the client needs to pay the amount for the remaining months. IBSMAXX reserves the right to terminate the annual maintenance at any point of time without any prior notice.
